1. Acceptance of Terms
These Terms of Use ("Terms") govern your use of the Drawing Desk – Doodle & Paint mobile application (the "App") provided by Sweta R. Patel ("we", "our", or "us").
By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
2. License to Use the App
Subject to these Terms and any applicable App Store rules, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.
You may not:
- copy, modify, or distribute the App except as allowed by law
- reverse engineer or attempt to extract source code except where prohibited by law
- use the App in a way that violates applicable law or third-party rights
- interfere with the operation or security of the App
3. App Features
The App currently includes features such as:
- drawing and painting tools
- save and load functionality
- export and share functionality
- premium subscription features
- rewarded ad-based temporary feature unlocks
We may add, remove, or change features at any time.
4. Subscriptions and Premium Features
Certain features are available only through paid subscriptions.
Subscription purchases are processed by Apple through the App Store.
By purchasing a subscription:
- you agree to the pricing, billing, and renewal terms shown by Apple at the time of purchase
- your subscription may renew automatically unless canceled through your Apple account settings
- refunds, billing issues, and subscription management are handled according to Apple's policies
We do not control Apple's billing systems.
5. Rewarded Ads
Some features may be temporarily unlocked by watching rewarded advertisements.
For example, the App may temporarily unlock the Dash and Neon tools after a completed rewarded ad.
Reward-based access:
- is temporary
- may expire automatically
- may be changed or removed in future updates
- does not grant permanent premium ownership
6. User Content
You retain ownership of the drawings and artwork you create using the App.
You are solely responsible for the content you create, export, or share.
You agree not to use the App to create, store, or share content that:
- infringes intellectual property rights
- is unlawful, abusive, defamatory, or harmful
- violates the rights of others
If you share exported content, you are responsible for that sharing activity.
7. Intellectual Property
The App, including its design, software, branding, text, graphics, and other non-user content, is owned by Sweta R. Patel or its licensors and is protected by applicable intellectual property laws.
These Terms do not transfer ownership of the App or any related intellectual property to you.
8. Availability and Changes
We may update, suspend, discontinue, or modify any part of the App at any time, with or without notice.
We do not guarantee that:
- the App will always be available
- all features will remain unchanged
- the App will always be error-free or uninterrupted
9. Privacy
Your use of the App is also governed by our Privacy Policy.
10. Third-Party Services
The App may use third-party services, including Apple and Google services for purchases, ads, consent management, and related functionality.
Your use of those services may also be subject to the third party's terms and privacy policies.
11. Disclaimers
The App is provided on an "as is" and "as available" basis to the fullest extent permitted by law.
We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not permitted by law.
12. Limitation of Liability
To the fullest extent permitted by law, Sweta R. Patel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or business interruption arising out of or related to your use of the App.
Where liability cannot be excluded, it will be limited to the maximum extent permitted by law.
13. Termination
We may suspend or terminate your access to the App if you violate these Terms or if required for legal, operational, or security reasons.
You may stop using the App at any time by uninstalling it.
14. Governing Law
These Terms are governed by the laws of India, without regard to conflict of laws principles.
Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
15. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we will update the "Last updated" date above and may provide additional notice where appropriate.
